Sexually assaulting a 16-year-old as she slept.
Havant man Daniel Cake, 42, has been given a 16-month jail sentence suspended for two years after sexually assaulting a 16-year-old girl.
The incident occurred after a party at the girl's home. Cake, who had been drinking and taking drugs, entered the girl's bedroom while she was asleep and assaulted her. She awoke and kicked him off the bed as her boyfriend woke up.
The court heard how a commotion ensued, resulting in Cake being punched and thrown out of the house. Police were called and Cake was arrested.
Despite the lenient sentence, the girl and her mother are determined to raise awareness about the incident and help other victims of sexual assault.
"I want everyone to know what he is really like and for me to help other girls who have had things happen to them," said the girl.
Her mother echoed these sentiments, stating, "I cannot believe he walked. He just has to be a good boy now for a while and that's it. I wanted him to be sent to prison. I can't believe he was not jailed. We feel let down by the justice system. What kind of a message does that send out?"
The mother also spoke about the impact the incident had on her daughter, saying, "It was horrific to have that call from my daughter telling me what happened. I never thought such a thing would happen to us. It is disgusting what he did. She was sound asleep and defenceless. He said he didn't remember doing it but how can anyone not remember doing such a thing? It was the biggest shock of her life."
Judge Timothy Mousley QC described the act as "appalling and shocking".
In a statement read to the court, the girl revealed how the incident had left her feeling dirty and paranoid.
"Before I was very sociable and would go out on my own but now I have to have someone with me all the time," she said.
She added, "What did I ever do to him?"
Cake's lawyer, Jason Halsey, called the incident "shocking, humiliating and embarrassing".
Cake admitted to a single count of sexual assault on a female aged 16 or over. He was also ordered to complete 35 rehabilitation days, subject to a 10-year restraining order and sexual harm prevention order, and to sign the Sex Offenders Register for 10 years.
