A 27-year-old man from Ash has been sentenced to five years in prison after being found guilty of rape.

Daniel Band had been on a night out in Aldershot when he met the victim with a friend on Saturday, December 14, 2013.

The three ended up at Band's house in Avondale, at about 3 am on Sunday, December 15, where they had more to drink and, according to the court, all fell asleep on the sofa.

During the trial of Band, who denied one count of anal rape, prosecutor Christopher May told the jury at Guildford Crown Court on Monday, February 8, that at one point in the evening the victim woke up and went outside for a cigarette.

Mr. May told the court that when she came back from having a cigarette, the two men were asleep. So she went back and sat on the sofa and fell back asleep herself, Mr. May said. There had been, according to the prosecution, no suggestion of sexual talk or foreplay or anything like that prior to this.

The court heard the victim's friend left the house, leaving her and the defendant in the living room.
