Performed sex act on man while he slept.

Bar manager David Madeley, 34, sentenced to 12 months in prison for sexual assault

David Madeley, 34, of Egerton Street, Chester, was sentenced to 12 months in prison after admitting to sexually assaulting a man who had accepted his offer of a place to stay after a night out.

Liverpool Crown Court heard that Madeley had been out drinking and offered the victim a place to sleep at his home. The victim, who was fully clothed, accepted the offer and slept at one end of Madeley's bed.

However, the victim woke in the night to find that Madeley had pulled down his trousers and underwear and was performing a sex act on him. A scuffle broke out as the victim tried to recover his clothes, resulting in broken bottles. The victim then fled the property and flagged down a police car to report the incident.

Madeley initially claimed that the act was consensual, but later admitted to the assault. He expressed remorse for his actions and fully cooperated with the police, pleading guilty at the earliest opportunity.

Judge Robert Trevor-Jones acknowledged Madeley's acceptance of responsibility but noted the victim was defenceless during the incident. He said: "It's quite clear there is a real and enduring impact on the victim."

In addition to the prison sentence, Madeley was also handed a five-year restraining order and placed on the sexual offenders register for seven years.
