A judge dismissed suggestions that a pervert broke the rules of a sex offenders' order due to his dyslexia.
Dwight Williams, a paedophile from Loftus, was sentenced to a Sexual Harm Prevention Order (SHPO) in December after being found in possession of indecent images of children, including some in the worst category of abuse.
Within weeks, Williams was apprehended for breaching the order. On February 1, police visited his residence to conduct a routine review of his devices. Williams pointed out a Playstation, hard drive, and laptop, but a search revealed two undeclared USB sticks and a mobile phone.
Examination of the phone revealed Williams had been using Snapchat and had sent and received over 1,000 messages that had been deleted. The Snapchat app automatically deletes messages after they have been read, making it impossible to determine the content.
Williams was also banned from using the Snapchat app. The court heard he had previously been cautioned for failing to register one of his aliases.
Williams pleaded guilty to the four breaches of the order. His defense attorney, Kelleigh Lodge, stated that he was in stable accommodation and was a "religious individual who has tried to make use of that on remand." She also argued that his dyslexia "takes him longer to understand certain things."
Lodge added, "He now seems to have a better understanding of the SHPO so that would hopefully prevent any further offending in the future."
Judge Jonathan Carroll ruled that the breach was "deliberate" and sentenced Williams to one year in prison. He also extended the SHPO by five years.
The judge stated, "Police asked you to identify any relevant equipment or devices that linked up to the internet. Your dyslexia could not have impacted on your understanding of that."
Carroll further stated that Williams' actions had "driven a coach and horses" through the order, which was designed to safeguard children. He emphasized the importance of compliance with the SHPO, stating, "I do not accept any explanation that you did not understand what was required, you simply failed to comply with it."
